Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the iOS application “Lustrous ToDo” (“the App”) provided by Jumpei Naka (“we”, “us”, or “our”).

By downloading, installing, or using the App, you are deemed to have agreed to these Terms. If you do not agree to these Terms, you may not use the App.

2. Definitions

For the purposes of these Terms, the following definitions apply.

  • “User”: Any individual who uses the App
  • “Service”: All features and services provided through the App
  • “Paid Service”: Subscriptions and one-time purchases offered within the App
  • “Premium”: The subscription service “Lustrous ToDo Premium”

3. Service Description

The App is a task management application with a gem-themed design. Main features include:

  • Creating, editing, and deleting tasks (To-Do)
  • Task completion and archive management
  • Due date/time and notification settings
  • Decorating tasks with gem designs

4. Account

The App is used through your Apple ID. Purchases and management of paid services are tied to your Apple ID.

You are responsible for managing your Apple ID and for taking appropriate measures to prevent unauthorized use by third parties.

5. Paid Services

5.1 Subscription “Lustrous ToDo Premium”

The App offers the following subscription plans:

  • Monthly plan: Renews automatically each month
  • Annual plan: Renews automatically each year

A Premium subscription provides access to:

  • All gem designs
  • iCloud backup

5.2 Free Trial

Subscriptions may include a free trial period. During the free trial, you can use Premium features at no charge.

When the free trial ends, unless you cancel in advance, your subscription will automatically convert to a paid subscription and your registered payment method will be charged.

5.3 One-Time Purchase

The App offers a one-time purchase option for “Lustrous ToDo Premium”.

The one-time purchase provides permanent access to the same features as the subscription:

  • All gem designs
  • iCloud backup

Once purchased, the one-time purchase is available permanently.

5.4 Renewal and Cancellation

Subscriptions renew automatically unless you turn off auto-renewal at least 24 hours before the end of the current period.

To cancel a subscription:

  1. Open the Settings app on your iPhone
  2. Tap your name (Apple ID)
  3. Tap “Subscriptions”
  4. Select “Lustrous ToDo”
  5. Tap “Cancel Subscription”

After cancellation, Premium features remain available until the end of the current billing period.

5.5 Refunds

Purchases are processed through the App Store. Refunds are subject to Apple’s refund policy.

6. Prohibited Conduct

When using the App, you must not:

  • Violate laws or public order and morals
  • Engage in or facilitate criminal activity
  • Infringe our or any third party’s intellectual property, portrait rights, privacy, reputation, or other rights or interests
  • Interfere with the operation of the App
  • Reverse engineer, decompile, or disassemble the App
  • Bypass or disable the App’s security features
  • Attempt unauthorized access
  • Use the App for commercial purposes without our permission
  • Engage in any other conduct we deem inappropriate

7. Intellectual Property

All intellectual property rights (including but not limited to copyright, trademark, and design rights) in the App belong to us or to third parties with valid rights.

Your license to use the App under these Terms does not grant you any license to use our or any third party’s intellectual property in the App.

You may not reproduce, modify, publish, distribute, or sell any content of the App without our prior written consent.

8. Disclaimers

8.1 Service Provision

The App is provided “as is.” We make no warranties, express or implied, that the App will meet your particular purposes, that it will have the functionality, value, accuracy, or usefulness you expect, that it will be continuously available, or that it will be free of defects.

8.2 Limitation of Liability

We are not liable for any damage (including direct, indirect, incidental, special, punitive, or consequential damage) arising from the use or inability to use the App, except in cases of our willful misconduct or gross negligence.

8.3 Data

We are not responsible for the preservation of any data stored in the App. We recommend that you regularly back up important data.

9. Changes and Termination

We may change the content of the App or discontinue the App without prior notice to you.

If we discontinue the App, we will endeavor to give you reasonable advance notice.

We are not liable for any damage resulting from changes to or discontinuation of the App.

10. Changes to the Terms

We may change these Terms as needed. Revised Terms take effect when posted in the App or on our website.

We will notify you of significant changes through in-app notices or other appropriate means.

Continued use of the App after changes constitutes your acceptance of the revised Terms.

11. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan.

Any dispute arising from or relating to the App or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court as the court of first instance.
